is my itouch tethered? can i remove it?

well i bought an ipod touch 8g, the repacked 2g, but i was wondering, is it tethered? and when i jailbreak it i cant turn it off or get a low battery? so can i remove the tether? or is there anothere jailbreak that gets rid of the tether? ps i have a 3.1.2 firmware
